This legal information applies to the social media channels of MyPostcard.com GmbH on the social networks / platforms; Facebook, Instagram, Pinterest, YouTube and Twitter. The provider of the social media channels is

II.             Data protection declaration for data processing in the context of our presence on social media platforms

We maintain so-called fan pages or accounts on the social networks / platforms Facebook (facebook.com), Instagram (instagram.com), Pinterest (pinterest.com), YouTube (youtube.com) and Twitter (twitter.com). In order to provide you with information and offers within the social networks, to place advertisements and to offer you other ways to contact us and to find out about our offers and services. During the following, we will inform you about which data we or the respective social network process in connection with the access and use of our fan pages / accounts.

1.    Responsible person and contact data protection officer

The person or body responsible in accordance with Article 4 (7) of the European General Data Protection Regulation (GDPR) is MyPostcard.com GmbH, Hohenzollerndamm 3, D-10717 Berlin. You can reach us at any time by post or email at support@mypostcard.com.

You can contact our data protection officer at any time if you have any concerns about data protection, e.g. by e-mail to datenschutz@mypostcard.com or at our postal address with the addition „the data protection officer“.

2.    Your rights

You have the following rights towards us with regard to your personal data (for personal data processed by the social networks, please see the information under section 4 below):

  • – Right to information (Art. 15 GDPR),
  • – Right to rectification (Art. 16 GDPR),
  • – Right to deletion (Art. 17 GDPR; “Right to be forgotten”),
  • – Right to restriction of processing (Art. 18 GDPR),
  • – Right to object to processing (Art. 21 GDPR),
  • – Right to data portability (Art. 20 GDPR).

You also have the right to complain to a data protection supervisory authority in the member state of your place of residence, your place of work or the place of the alleged violation about the processing of your personal data by us if you are of the opinion that the processing of the personal data concerning your data is illegal.

If you have given us your consent to the processing of your data, you can revoke this at any time with effect for the future. This does not affect the legality of the processing of your data until you withdraw your consent.

To assert your rights or for other data protection concerns you may have, you can contact us at any time using the contact channels listed in Section 1 above and / or the contact details listed in our legal information.

3.    Extra information regarding your right to object

We would also like to point out that if your personal data is processed on the basis of a legitimate interest within the scope of the balancing of interests as in accordance with Art. 6 (1) sentence 1 f) GDPR and / or your personal data is processed for direct marketing purposes, you have the right to object to the processing of your personal data at any time.

4.    Personal data that we process

a) Participation in giveaways / campaigns

If you have a user account with the respective social network and, for example, take part in a competition or a similar campaign organized by us on Facebook or Instagram and / or you want to contact us via the messaging functions offered, we will collect the data from you that are required for participation in and implementation of the competition, including notification of the prize and its dispatch. This is usually the participant's username, and the winners will also be asked for their real name and address and, if applicable, their email address after the notification of the prize has been sent. The legal basis is Article 6 Paragraph 1 Clause 1 b) GDPR (processing is necessary for the fulfillment of a contract-like relationship with the person concerned).

b) Facebook LeadAds (Giveaways and similar campaign)

If you register via an advertisement placed by us on the social network Facebook (so-called lead ad), e.g. for a competition or a similar campaign, which we carry out, a form opens after clicking on the ad. Your contact details are already filled in automatically based on the information you shared on Facebook, i.e. your name and email address. Depending on the content of the campaign, you may also be asked to provide your address and, if necessary, additional data, insofar as this is necessary for the advertised campaign.

You can edit your contact details before submitting the form and by clicking "Send" you complete the registration. We only receive your name, your email address and, depending on the subject of the campaign, your address and your date of birth along with the notification that you have registered for the competition or the respective advertised campaign via the advertisement. We use and process this data exclusively in connection with your registration or participation in the competition or the respective campaign. With regard to your data protection rights, please see above under b). The legal basis for the processing described above is Article 6, Paragraph 1, Clause 1 b) GDPR (processing is necessary for the fulfillment of a contractual or contract-like relationship with the person concerned).

c) Contact via Messenger/ Direct Message

If you would like to contact us via messenger or direct message via the respective social network, we usually process your username, which you use to contact us and, if necessary, save other data you have provided (e.g. the content of your request), insofar as this is necessary to process / answer your request. The legal basis is Article 6, Paragraph 1, Clause 1 f) GDPR (processing is necessary to safeguard the legitimate interests of the person responsible). Our legitimate interest is to enable our users to conveniently and easily contact us via our channels on social networks.

d) (Static) usage data that we receive from social networks

We automatically receive statistics relating to our fan pages / accounts from the social networks - in the case of Facebook and Instagram via the functionalities Facebook Insights and Instagram Insights - that are provided on a regular basis. Depending on the social network, the statistics contain, among other things, the total number of page views, likes, information on page activities and post interactions, reach, video views / views and, in some cases, information on the proportion of men / women among our fans / followers and statistics / measurement data for reach and the success of our advertisements placed on social networks.

The statistics only contain aggregated data that cannot be traced back to individual persons. We cannot identify you in this way.

5.    Which data the social networks process about you / your rights with regard to the social networks

In order to be able to view the contents of our fan pages or accounts, you do not have to be a member of the respective social network and, in this respect, no user account is required for the respective social network.

Please note, however, that when the respective social network is called up, the social networks also collect and save data from website visitors without a user account (e.g. technical data in order to be able to display the website to you) and use cookies and similar technologies, over which we have no influence. You can find details on this in the data protection provisions of the respective social network (see the corresponding links below at the end of this section)

Insofar as you want to interact with the content on our fan pages / accounts, e.g. want to comment, share or like our posts / contributions and / or participate in competitions or similar campaigns organized by us on the fan pages / accounts and / or would like to contact us via Messenger functions, prior registration with the respective social network and the provision of personal data is required.

We have no influence on how the social networks handle data processing iin the context of your use.

To the best of our knowledge, your data is stored and processed in particular in connection with the provision of the services of the respective social network, and also to analyze usage behavior (using cookies, pixels / web beacons and similar technologies) upon which your interest-based advertising is based and run both inside and outside of the respective social network as well as for advertising and marketing purposes. It cannot be ruled out that your data will also be stored by the social networks outside the EU / EEA, e.g. in the USA and also passed on to third parties.

Information on the exact scope and purposes of the processing of your personal data, the storage period / deletion as well as guidelines for the use of cookies and similar technologies in the context of registration and use of social networks can be found in the data protection provisions / cookie guidelines of the social networks, where you will also find information on your rights and options to object.

We recommend that you assert your data protection rights to information, correction, deletion, restriction of processing, objection and data transfer directly to the respective social network, insofar as data processing by the social networks is concerned:
